VACATING OF ALLEYWAYS IN THE

VILLAGE OF CERRO GORDO

 

 

            BE IT ORDAINED by the President and Board of Trustees of the VILLAGE OF CERRO GORDO, Piatt County, Illinois, THAT:

 

            SECTION I:    That there are certain alleyways and portions of alleyways located in the Village of Cerro Gordo described as follows:

 

            1.  Beginning at the Northeast corner of Lot One (1) of Plat recorded in

            Deed Record Book 26 at Page 252 of the Piatt County Recorder’s Office

            (said Plat being a Plat of Lot 4 and the East Half of Lot 5 of Durfee &

            Wait’s Addition to the Village of Cerro Gordo), thence Westerly along

            the North Line of Lots 1, 2, 3 and 4 to the Northwest corner of Lot 4,

            thence Northerly along the East line of Lots 11, 12, 13 and 14 to the

            Northeast corner of said Lot 2, thence Easterly along the South line of

            Said Lots 10, 9 and 7 of said Plat to the Southeast corner of said Lot 7,

            thence Southerly to the Northeast corner of said Lot 1 (the Point of

            Beginning);

 

            2.  Beginning at the Northeast corner of Lot 10 of Long’s Subdivision of

            Lot 7 of Durfee’s West Addition to the Village of Cerro Gordo, thence

            Westerly along the North line of Lots 10, 9, 8, 7 and 6 of said Subdivision

            To the Northwest corner of said Lot 6, thence Northerly to the Southwest

            Corner of Lot 1 of said Subdivision, thence Easterly along the South line

of Lots 1, 2, 3, 4 and 5 of said Subdivision to the Southeast corner of said

Lot 5, thence Southerly to the Northeast corner of said Lot 10 (the Point of

            Beginning);

 

            3.  Beginning at a point 16 feet Easterly of the Northeast corner of Lot 1

            of Mrs. Frantz’s Subdivision of Lot 19 and part of Lot 20 of Durfee &

            Wait’s Addition to the Village of Cerro Gordo, said 16 feet being an

            Extension East of the North line of said Lot 1, thence Southerly parallel

            with Lots 1 thru 10, both inclusive, of said Subdivision to a point directly

            East of the Northeast corner of said Lot 10, thence West to the Southeast

            Corner of said Lot 10, thence Northerly along the East line of said Lots 10

            thru 1, both inclusive, the Northeast corner of said Lot 1, thence Easterly

            16 feet along an extension of the North line of said Lot 1 to the Point of

            Beginning;

4.  Beginning at the Southwest corner of Lot 5 of Blickenstaff Subdivision

            of Lot 12 and the West Half of Lot 13 of Durfee & Wait’s Addition to the

            Village of Cerro Gordo, thence Easterly along the South line of Lots 5, 4, 3,

            2, and 1 of said Subdivision to the Southeast corner of said Lot 1, thence

            Southerly to the Northeast corner of Lot 10 of said Subdivision, thence Westerly

            along the North line of Lots 10, 9, 8, 7 and 6 of said Subdivision to the  North-

            west corner of said Lot 10, thence Northerly to the Southwest corner of said

            Lot 5 (the Point of Beginning);

 

            5.  Beginning at the Northwest corner of Lot of Frantz’s Addition of Outlots to

            the Village of Cerro Gordo, thence Southerly along the West line of Lots 2

            and 3 of said Subdivision to the Southwest corner of said Lot 3, thence

            Easterly along the South line of said Lot 3 to the Southeast corner of said Lot

            3, thence Easterly along the South line of said Lot 3 to the Southeast corner

            of said Lot 3, thence Southerly to the Northeast corner of said Lot 3, thence

            Southerly to the Northeast corner of Lot 12 of said Subdivision, thence

            Westerly along the North line of said Lot 12 to the Northwest corner of said

            Lot 12, thence Southerly along the West lines of Lots 12, 13, and 14 of said

            Subdivision, thence Northerly to the Southwest corner of Lot 7 of said

            Subdivision, thence Easterly along the Southerly line of Lots 7, 6, 5 and 4

            of said Subdivision to the Southeast corner of said Lot 4, thence Northerly

            along the East side of said Lot 4, thence Easterly to the Northwest corner of

            said Lot 2 (the Point of Beginning);

 

            6.  Beginning at the Southeast corner of Lot 1 in Block 10 of the Subdivision

            of Blocks 10 and 11 of Durfee’s West Addition to the Village of Cerro Gordo,

            as recorded in Book 26 of Deeds, Page 24 of the Piatt County Records, thence

            Westerly along the South lines of Lots 1, 2, 3, 4 and 5 of said Block 10, thence

            South 12 feet to the Northwest corner of Lot 6 of said Block 10, thence

            Easterly along the North lines of Lot 6, 7, 8, 9 and 10 of said Block 10 to the

            Northeast corner of said Lot 10 in Block 10, thence Northerly 12 feet to the

            Southeast corner of said Lot 1 in Block 10 (the Point of Beginning);

 

            7.  Beginning at the Southeast corner of Lot 10 in Block 10 of the Subdivision

            of Blocks and 11 of Durfee & Wait’s Addition to the Village of Cerro Gordo,

            as recorded in Book 26 of Deeds, Page 244 of the Piatt County Records, thence

            Westerly along the South line of Lots 10 and 9 of said Subdivision to the

            Southwest corner of said Lot 9, thence Southerly 12 feet to the Northwest

            Corner of Lot 2, in Block 11, of said Subdivision, thence Easterly along the

            North line of Lots 2 and 1 of said Block 11 to the Northeast corner of said Lot

            10 in Block 10 (the Point of Beginning);

 

            Section II.  That the corporate authorities have determined that the public

Interest will be sub served by the vacation of said alleyways.

            Section III.   That said alleyways are hereby vacated, subject to the reservation by the corporate authorities of an easement over the middle 10 feet of said vacated alleyways for the purpose of maintenance, renewal, construction or reconstruction of any public utility facilities.

           

            THIS ORDINANCE was presented, approved and passed this 5th day of September, 1989, by aye and nay votes, wherein all the Trustees voted aye and said Trustees voting being more than three-fourths of the Trustees then holding office.

 

            APPROVED this 5th day of September, 1989.
