ORDINANCE NO. 439

CONDEMNATION ORDINANCE

 

            BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF CERRO GORDO, ILLINOIS AS FOLLOWS:

 

            1.         That the public use of the property described below is for a water main pipeline to convey water from its origination to the Village of Cerro Gordo;

 

            2.         That the specific property to be condemned is as follows:

 

                        The East 10 feet of the West 15 feet and the East 35 feet

                        of the West 50 feet of the North 100 feet, all of said

                        property being located in the West Half (W ฝ) of the

                        Southwest Quarter (SW ผ) of Section 1, Township 17

                        North, Range 4 East of the 3rd P.M., situated in Piatt

                        County, Illinois;

 

            3.         That said property is necessary for the contemplated public use;

 

            4.         That said Village has heretofore, by Resolution, authorized Attorney Walter Burger, Jr., to contact the owners of said property in an attempt to agree to proper compensation and further said Village has, on two occasions, met with the then owner or representative of the owner of the property in an attempt to agree on proper compensation and there has been no agreement;

 

            5.         That the attorney for the Village, Walter Burger, Jr., is hereby authorized to contact the owners by letter on one more occasion setting out the terms that the Village is willing to settle upon; and,

 

            6.         That in the event that neither said attorney nor said Village hears from said owners on or before December 21, 1998, the Village, by this Ordinance, authorizes said attorney to institute condemnation proceedings to obtain title to said property.

 

            This Ordinance was passed this 7th day of December, 1998, by a vote of 4 yeas and 0 nays, being a majority and being all of the Trustees present at said meeting.
