VILLAGE OF CERRO GORDO

ORDINANCE NO. 457

 

AN ORDINANCE OF THE VILLAGE OF CERRO GORDO TO AMEND THE

TEXT OF SECTION II PARAGRAPHS 25 AND 27 AND SECTION X OF

ZONING ORDINANCE NO. 422

 

 

            WHEREAS, the President and Board of Trustees of the Village of Cerro Gordo believe the text of Zoning Ordinance No. 422 should be amended to provide for Manufactured Homes to be added to the list of potential Special Uses under Section X of the Zoning Ordinance No. 422 under certain terms and conditions and Section II Paragraphs 25 and 27 concerning the definition of “Mobile Home” and “Modular Home” need to be amended to provide for a clear distinction between the two types of homes.

 

 

            NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF CERRO GORDO, ILLINOIS, AS FOLLOWS:

 

            Section 1:  The following shall replace the current Section II, paragraph 25 of Zoning Ordinance No. 422 passed and approved on August 7, 1995 and made a part of the Code of Ordinances of the Village of Cerro Gordo and said paragraph shall hereinafter read as follows:

 

            25.  MANUFACTURED HOME:  A manufactured home is a structure whose

            construction standards are established by the federal Department of Housing and

            Urban Development (HUD) and which is transportable in one or more sections,

            which, in the traveling mode, is eight body feet or more in width or forty body

            feet or more in length, or when erected on site, is 320 square feet or more, and

            which is build on a permanent chassis and designed to be used as a dwelling with

            or without a permanent foundation when connected to the required utilities and

            includes the plumbing, heating, air conditioning, and electrical systems contained

            therein.  This definition excludes motor homes, travel trailers, campers, and tents.

 

            Section 2:  The following shall replace the current Section II, paragraph 27 of Zoning Ordinance No. 422 passed and approved on August 7, 1995 and made a part of the Code of Ordinances of the Village of Cerro Gordo and said paragraph shall hereinafter read as follows:

 

            27.  MODULAR HOME:  A modular home is a building assembly or system of

            sub-assemblies, designed for habitation as a dwelling for one or more persons,

            including the necessary electrical, plumbing, heating, ventilating and other service

            systems, which is of closed or open construction and which is made or assembled

            by a manufacturer, on or off the building site, for installation, or assembly and

            installation, on the building site, with a permanent foundation and which is

            regulated by the Illinois Department of Public Health and meets the specifications

            of the One and Two Family Dwelling Code (1983) and the Illinois State Plumbing          Code (1986) with amendments and the National Electrical Code (1984) and the

            Model Energy Code (1983) and the BOCA National Building Code, 10th Edition,

            1987.

 

            Section 3.  The following shall be added as subparagraph (o) under the current Section X, paragraph A of Zoning Ordinance No. 422 passed and approved on August 7, 1995 and made a part of the Code of Ordinances of the Village of Cerro Gordo and said new subparagraph (o) shall read as follows:

 

                                    (o) Mobile Homes having a minimum width of the main body as

                        assembled on the site of not less than 20 feet measured across the

                        narrowest portion and meeting the construction standards of the United

                        States Department of Housing and Urban Development Federal Code

                        Known as the National Manufactured Home Construction and Safety

                        Standards and any amendments thereto.

 

            Section 4.  This Ordinance shall be in effect upon its passage, approval and publication as provided by law.

 

            Section 5.    Should any article, section, provision, part or clause of this ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be invalid.

 

            Section 6.  Any ordinances or parts of ordinances in conflict herewith are hereby repealed.
